Electronic surveillance

Audio and video recording devices are becoming more prevalent in and on many residential properties. Although some listings on the MLS will mention the presence of such devices, list agents are not required to disclose such information on their listings.

SmartMLS advises agents to be cognizant of electronic surveillance and to make their buyers aware of this possibility when viewing/entering properties. Private conversations about properties should be held outside of the potential viewing/recording area.

Please note: there may be state and federal laws governing the use of electronic surveillance. It is the responsibility of each agent to make sure that he or she performs their due diligence to comply with these laws.
